Agreement

“By creating an account and adding a site, you agree to these Terms.”

Welcome to RewardTune. These Terms of Use (“Terms”) govern the use of the services provided by RewardTune (“Company”, “we”, “us”, or “our”).

The website www.rewardtune.io (the “Website” or “Platform”) is operated by us. The Service is our CPA network, offerwall, Market Research surveys, CPI and CPA offers, and any other service on the Website. By accessing or using the Service, whether you have an account or not, you agree that you have read and accepted these Terms.

We may change these Terms. If you keep using the Service after a change, you accept the Terms as amended. Checking this page keeps you up to date on the rules that apply to the Service and to your account.

If we believe a change is material, we will post a notice on the Website or email the address you gave us. We decide what counts as a material change.

You are bound by these Terms

By using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service for a company or other legal entity, you confirm that you have authority to bind that entity.

Accessing, browsing, or otherwise using the Website is your agreement to these Terms. Please read them before you continue.

By using the Service, you also agree to these policies, and to any further policy we tell you about. They apply to all users:

Some rules below apply if you use the Service as a publisher or on the offerwall. Advertisers are also bound by the Advertiser Agreement.

Publisher rules

These rules apply when you add a site, place the offerwall, or earn a commission.

You may add only sites that are live and that you own. We may reject a site, including a site that carries illegal content, and we do not have to give a reason.
If you place our offerwall, it must sit where a visitor can see it. Do not use excessive pop-ups, redirects, or a misleading placement.
Keep every site on one account. If you open another account, we may close the accounts involved and forfeit earnings from that activity.
You must not promote offers by sending email.
You must not use a proxy, VPN, or VPS to complete offers on your own account. Use your own connection and your own details. A proxy can lead to suspension, and further abuse can close the account.
If most of a publisher’s leads are fraudulent, we may suspend the account and withhold unpaid commission.
We may reverse a credit that came from fraud. That includes a completion made with a proxy, a bot, or the same person completing an offer more than once. If a reversal leaves the balance below zero, you must bring the account back to zero or above. Sites can stay suspended until the balance is corrected.
We may place an account on hold if activity looks suspicious, until the review is finished.
We may check a website, app, blog, or public social presence before a payment is released.
The minimum payout is $25. Standard terms are NET-30 and NET-90. Some publishers may qualify for NET-15 or bi-weekly payouts. Payouts are sent by PayPal, or by bank transfer in India. A request made during a payment period is timed from the end of that period.
Payment can take longer when we need to verify the account, the traffic, or the payment details. We may extend that time if a withdrawal looks unusual or still needs to be checked.
We are not liable to pay any kind of taxes on the amount earned by publishers. All publishers are liable to pay their taxes themselves in their respective countries. All kinds of taxes, either direct or indirect, including income tax, service tax, GST, VAT, or any other form of tax, must be paid by publishers themselves based on the tax rules of their country.
A publisher is an independent contractor, not an employee of RewardTune, and is not entitled to employee pay or benefits.
If a site or account breaks these rules, we may close it. Amounts tied to a breach are not refunded.

Offerwall

These rules apply when you take part in an offer or a task on the offerwall.

Do not open the offerwall through a VPN, proxy, or other anonymizing service.
Do not submit a task with information that is false or misleading.
Do not submit a task before you have met the advertiser’s requirements. A task that does not meet them can be rejected. Repeating that can lead to a ban.
Fraud, or a pattern of fraud, can block you from the offerwall.
RewardTune does not check or endorse the claims in an advertisement. Before you give personal information, or pay for anything an ad offers, check it yourself.

Accounts and passwords

To use the publisher side of the Service you create an account with an email address, a password, and the details we ask for.

The details on the account must be accurate, complete, and current. You agree to update them when they change. If you do not, we may suspend or close the account. Do not share your password. Tell us at once if someone uses the account without your permission. You are responsible for activity that can be traced to your email or password, and you must report a lost or stolen password or email straight away.

RewardTune is not responsible for checking that every personal detail a user sends us, or sends to someone acting for us, is authentic.

Do not pretend to be another user, and do not register or sign in as another person. Keep the information you give us true, accurate, current, and complete.

If information is untrue, inaccurate, misleading, out of date, or incomplete, or we have reasonable grounds to think that it is, we may suspend, block, or close your access.

RewardTune and its personnel are not liable for loss that flows from information you supplied. You agree to indemnify RewardTune and its personnel as set out in the indemnity section below.

What you must not do

You represent and warrant that your use of the Platform and the Service will not break applicable law; that information you submit is true, accurate, and lawful; and that content you supply does not break these Terms and will not injure any person or entity, including by being defamatory. If information you gave us is false or inaccurate, we may reject the registration, reverse related credits, and restrict future use of the Service, without prior notice. You agree to indemnify us and our affiliates against third-party claims that arise from a breach of these warranties.

Use the Platform only for lawful purposes, and not in a way that harms the Platform or its content. You have a limited licence to access the Platform so you can use the Service, subject to these Terms.

You will not do any of the following:

Delete or change content on the Platform that you do not own and do not have permission to change, including notices, disclaimers, copyright or trademark marks, or logos.
Decompile, reverse engineer, or disassemble content on the Platform.
Use the Service in a way that is unlawful, or that harms RewardTune or any other person, as we decide.
Use spiders, robots, or similar tools to navigate or search the Platform.
Frame the Website, mirror the homepage, or use our name, logo, or marks in meta tags or hidden text, without our prior written consent.
Make false or malicious statements about the Service, the Platform, or us.
Upload or send a virus or other harmful component, or disrupt the Platform, the Service, or a connected network.
Introduce malware or bots, or scrape the Platform.
Probe, scan, or test the vulnerability of our systems, or tamper with our technical design.
Hack the Platform or place malicious software on it.
Access without permission, or interfere with, a server or database connected to the Service.
Engage in flaming, spamming, flooding, trolling, phishing, or griefing, as those words are commonly used on the internet.
Commit fraud, including fraudulent clicks, repeated manual clicks, incentives to click, robots, or other deceptive software.
Host or share information that is defamatory, abusive, threatening, harassing, hateful, or offensive; that belongs to someone else; that is obscene, pornographic, or harmful to minors; that invades privacy; that encourages money laundering; that infringes intellectual property; that breaks the law; that misleads someone about who sent it; that impersonates another person; or that contains a virus or other code meant to interrupt a computer.

Offer content

Banners, photographs, images, video, descriptions, advertisements, questionnaires, mobile applications, software, games, and similar material shown in the offerwall or the network are there to advertise or promote something. They are created by or for third parties. They are not the property of RewardTune.

Interruptions

We try to keep the Website available and to a good standard. The internet is not a stable medium. Errors, omissions, interruptions, and delays can happen. We do not accept liability for those, and we do not promise that the Website, or any part of it, will keep running. We may change how the site works without notice.

Information on the site

We are not responsible if information on the Website is not accurate, complete, or current. Material on the Website is general information. Do not treat it as the only basis for a decision. Reliance on it is at your own risk.

We may change the Website at any time. We do not have to update every page. You are responsible for checking for changes.

We may stop the Service, or any part of it, without notice. We are not liable to you or to any third party for a modification, suspension, or end of the Service.

No spam

RewardTune does not allow spam. If you send spam, or sign up more than once, we may close every account involved and recover earnings taken through that activity. Signing up more than once from the same computer is also fraud.

Sending unsolicited advertising to our email addresses, or through our systems, is prohibited. Unauthorised use of our systems breaks these Terms and may break applicable law. The sender and their agents may face civil or criminal penalties.

Intellectual property

“Intellectual property rights” means rights under patent, copyright, moral rights, trade secret, trademark, unfair competition, publicity, and privacy law, and any application, renewal, or extension of those rights, anywhere in the world.

Material on the Website, including images, illustrations, text, graphics, logos, icons, audio, downloads, data compilations, and software, belongs to us, our affiliates, or our content suppliers. It is protected by intellectual property law in India and elsewhere.

The compilation of content on the Website is our exclusive property.

Do not copy, reproduce, republish, upload, post, transmit, or distribute that material, including by email, and do not help anyone else to do so. You may use it only to use the Service as these Terms allow, including placing the offerwall on a site you have added. Without our prior written consent, you may not change that material or use it for any other purpose.

Privacy and email

How we collect, use, and share personal information is set out in the Privacy Policy. By using the Website, you accept that policy.

If you create an account, you opt in to newsletters and other messages from the Website. You can opt out of promotional email at any time. Details of how we use personal information, and of cookies, are in the Privacy Policy and the Cookie Policy.

Indemnity

You are personally responsible for your behaviour on the Website. You agree to indemnify, defend, and hold RewardTune, its affiliates, and their officers, directors, employees, and agents harmless from claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, that result from your use, misuse, or inability to use the Website or its content, or from your breach of these Terms.

Third-party links

The Website may link to third-party sites. If you follow a link, you leave our Website. We do not own or control those sites, their content, or their privacy practices. Read the privacy policy of a site before you send it personal information.

We disclaim liability for information, materials, products, or services posted or offered on third-party sites linked from this Website. A link is not an endorsement of that site, and we are not liable if a product or service offered there fails. A third party may have a different privacy policy, and that site may be less secure than this one.

No warranty

The Service is provided on an “as is” and “as available” basis. Your use of the Service, and of any content or service you reach through it, is at your sole risk.

We do not represent or warrant that the Service will be secure, timely, uninterrupted, or error free, or that it will work with other hardware, software, systems, or data; that it will meet your requirements; that errors will be corrected; or that the Service and our servers are free of viruses or other harmful components.

All conditions, representations, and warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, are excluded to the fullest extent the law allows.

The Service can be affected by limitations and delays that come with the internet, electronic communications, and the device you use.

Advice or information you get from us or from the Service does not create a warranty. We have no obligation to support or maintain the Service.

We may change, correct, add, discontinue, or retire any part of the Website or the Service, including the equipment needed to use it, or whether it is available on a particular device. We do not have to notify you or a business partner of that change, and we do not have to provide support, fixes, updates, or enhancements.

Your use of this Website is at your sole risk. RewardTune disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement for the Service and for Website content, and for any reliance on that content. Without limiting that:

We do not warrant that information on this Website is accurate, reliable, complete, or timely.
We do not warrant that information on linked third-party websites is accurate, reliable, complete, or timely.

No advice or information, oral or written, obtained from this Website creates a warranty that is not stated in these Terms.

Limitation of liability

To the fullest extent the law allows, RewardTune and its directors, officers, employees, agents, and content or service providers (together, the “RewardTune representatives”) are not liable to you for any direct, indirect, special, incidental, consequential, exemplary, or punitive damage. That includes loss of profits, goodwill, use, data, or other intangible losses, and lost business, arising from the use of or inability to use the Platform, its content, or the Service, even if a RewardTune representative has been advised of the possibility of that damage.

In any event, RewardTune’s aggregate liability to you shall not exceed the unpaid commission balance on your account at the time the claim arises. If no commission is unpaid, that limit is zero, except where the law does not allow this limit.

Who can use the Service

A publisher account may be opened only by a person who is 18 or older and who can enter a binding contract under the Indian Contract Act, 1872. People who are incompetent to contract under that Act, including undischarged insolvents, may not use the Website to open an account.

We do not knowingly allow a child under 13 to use the Service. A person aged 13 to 18 may browse the Website or take part in an offer only with the permission of a parent or legal guardian. That permission does not allow them to open a publisher account. We may refuse access if we learn that someone under 18 is using the Service without that permission.

If a user gives a false age, RewardTune is not liable for that. The user, and where relevant a parent or guardian, is responsible under applicable law. We disclaim liability for unauthorised use of the Platform by a minor, and for third-party claims that arise from that use.

Notices

Legal notices to us must be sent to the email address in the contact section. Notice is treated as given 48 hours after the email is sent, unless the sender is told that the address is invalid or that the email was not delivered. We may give you legal notice by email, or by post to the address on your account. A posted notice is treated as given three days after the date of mailing.

If these Terms are broken

If you break these Terms, RewardTune may end your access at once, without notice, remove the material, and report the matter to the authorities where the law allows.

If we end your access, we may delete data and files stored for you on our servers. You agree that we are not liable for that deletion.

Disputes

If a dispute arises, contact us first so we can try to resolve it. If that does not resolve it, send formal notices to the email address in the contact section. We will consider mediation or arbitration under the laws of India as an alternative to going to court.

The place for that alternative dispute resolution is Gorakhpur, Uttar Pradesh, India.

If a dispute goes to a court or to arbitration, the party that succeeds may recover reasonable legal costs to the extent that forum is allowed to award them.

Governing law

These Terms, and any separate agreement under which we provide the Service, are governed by the laws of India. The courts named below have exclusive jurisdiction over a dispute under this agreement.

Claims and disputes arising out of the Service, these Terms, or a transaction on the Service are subject to the exclusive jurisdiction of the district courts at Gorakhpur, Uttar Pradesh, India, and you accept that jurisdiction.

Decisions on gaps

If an issue is not covered by these Terms, or if there is a difference of interpretation, the chief executive of the Company may take a decision. That decision is final.

General

Severability. If a provision is invalid, illegal, or unenforceable, it is modified to the minimum extent needed to make it valid. If that is not possible, the provision is treated as deleted. The rest of these Terms still applies. The parties will negotiate in good faith to replace a deleted provision with one that is valid and as close as possible to the original result.
Entire agreement. These Terms, and the policies and operating rules we post, are the entire agreement between you and us. They replace earlier agreements and communications, oral or written. An ambiguity is not read against the party that drafted the Terms. If you breach these Terms and we do not act, we can still use our rights if you breach them again.
Waiver. If we do not enforce a right, that is not a waiver of the right.
Headings. Headings and bold type are for convenience and are ignored when interpreting these Terms.
Assignment. You may not transfer your account, or your rights or duties under these Terms, without our prior written consent. Consent does not release you from duties you still owe.
No third-party rights. These Terms are only between you and RewardTune. They do not give rights to anyone else.
Events outside our control. If a party cannot perform because of a cause beyond its reasonable control, such as a natural event, fire, government action, war, civil unrest, a strike, or the loss of labour or materials that cannot reasonably be replaced, that performance is excused for as long as the cause continues.

Changes

RewardTune may amend these Terms when needed to keep the standard of the Service or to improve it, without prior notice. The amended Terms apply from the time they are posted.

Review this page from time to time. Continued use is subject to the Terms as amended.
